One of the drivers on a percentage of take asked the controller to delete his booking records for the day.

If the controller did delete them would they be breaking the law?

I assume that it is private hire and if so, in our area the record must be kept. Why would someone want their bookings deleted? That sounds very fishy indeed.

That would depend on the PH Operator conditions.

He is trying to make it appear he wasn't working when he was. That way he can take the days takings for himself

He often "forgets" to put his meter on too especially on the longer jobs so he'll call in for a quote that goes in his pocket too.

We are going to tell the owner what he is up to, they work abroad a lot so we have to wait till they are back

I just was concerned about the legal side if one of the controllers did as he asked

The operator who employs the controller would be outside of the law, as he could not show his LOs what the LOs have a legal right to see.

I would guess that, legal side apart, if the controller deletes the record and the owner finds out then the controller will be looking for a new job as well as the driver.

A breach of the operator's 'conditions of license' is an unlawful act. :?

Of course if the action to delete the details of the jobs effected the amount of income tax due from the driver, then that could lead to jail.

And you have to wonder if deleting the jobs was really down to the commission the driver would have paid.

I dont see that as relevent tbh.

Most drivers pay a fixed amount per week to hire the radio equipment....I havent heard any stories about the revenue checking booking records for that matter either.

If it was a condition of license to retain records.....for a first offence the operator would probably get a slap on the wrists.....a harsh penalty like errm suspension or revoking the license.....if that happend would result in someone else taking over the operators license.

Cant see it going to court.....unless of course the licensee appeals.

The driver could also be trying to claim that he wasn't working because he had done something that he shouldn't.

The owner pays the radio rent to the office he pays them commission on the work he does from our system

I know it sounds an odd way to carry on but it works for them, or did till he started trying to fiddle.
