Can a hackney carriage driver appeal to the courts on a decision by a local authority to NOT limit hackney carriage vehicle numbers... i.e. too many hackney carriage vehicles licensed and a request to introduce or reintroduce a limit was refused........interested to hear you opinions and views. I'm thinking this from the unrest we hear up and down the country about HC vehicles and no limits. Comments? |

Comments? IMO no.....but the council decision could be questioned via judicial review, I fear however, due to the plethora of court cases in favour of deregulation, this would be a costly failure. CC |

Parliament allows councils to de-limit, and I doubt any court will view that as illegal or irrational, especially when it's DfT Best Practise. IMO the only way to change a policy of de-limitation to one of limitation is to lobby councillors. And I wouldn't wish that task on anybody. |
