I recently reported to our council that there is a taxi going around town with a plate that expired over 3 weeks ago. They want me to document chronologically every instance of seeing this car with descriptions of the driver and passengers. They say that they are not allowed to follow this car and collect evidence without a warrent and it is very difficult to convince a magistrate to issue one. How would this be handled in your manor? |

I wonder what would happen in all these cases in whichever LA, if concerned drivers like you & I didn't bother to inform LOs verbally, but wrote in recorded delivery in every case, with copies of the letter sent to every councillor on the Licensing Committee? I bet the LO would sh*t his self into action!!! |

The easiest way is to do a test purchase i.e. get the council LOs to book the taxi. Otherwise report it to the local police as an unlicensed taxi. Sussex police have an on-line system to report any illegal cars. Especially insurance breaches. Which is why we don't see too many Limos about now.

Not sure what warrant a JP could give to stop an unlicensed taxi.

Do you mean she needs to be trained? If so that makes sense, but there is nothing stopping anyone at the council speaking to the chap. In fact their enforcement code might insist that the driver gets at least one warning. |

Your council has a duty of care... because of this it can attach conditions to the licence.... in Sefton you're required to retain your plates at expiry otherwise you'll be prosecuted and fined... if somebody were to be driving with expired licence they would simply receive a letter telling them to return the licence plates or be prosecuted , if you're plates are stolen you have to notify the council.... if somebody else is using them they will be prosecuted for theft.....ps.the best way of dealing with a problem is at the beginning........ and not cleaning the mess up at the end

How would this be handled in your manor? In this area you are supposed to return the plates to the council. The fact is that the car has not been replated, we have annual plates. The council send out a reminder about 1 month before the plate is due for renewal and another about 1 week before renewal. The company that own the car have not even sent the paperwork in yet and are continueing to just use the car. This same company never use the meter and insist that their fixed fares are always less than the metered rate. I have asked them for some prices and some are 50% over what the metered fare would be but the council still insist that they are powerless to do anything. |

I think a report to the police that this unlicensed uninsured taxi is plying it's trade in your manor might help. Else e-mail the Chief Executive of your council asking if he is happy that nothing is being done. Or go to the local press.

It sounds to me like this company are very generous with Christmas presents & perhaps other presents to the LO!!!

The owner is quite an influencial person within the industry in the county. He is on all the committees and working parties. Maybe dodgy handshakes are being used.
