Hi everyone , firstly can i say how great this site is with information hence i joined......... Question - I am a new applicate for a private hire drivers licence. I have a police Simple Caution for "theft" which isnt that old. The circumstances of me getting that Simple Caution are straight forward and an honest mistake , IE it hasnt involved me going out and stealing from someone or a premise or robbery or act from employment ! and i have explained it to the council involved from the start. Everything else is great , i have passed my knowledge test , medical , dsa test and my crb has come back with this one caution which i have been honest about from day one. They have sat me down and gone through it again and its gone to someone for a decision at the top...... Do you think i will be allowed a licence , i am in my 40`s and this is the only trouble i been in ??? Thank you all |

in theory it shouldnt be a problem, in practice it only takes 1 trumped up "head up own arse" official to stop your application, but i think you have the right to appeal |

In your favour is the fact that you have been honest from the beginning, but without knowing what the situation was when you received your caution & there's no point posting it on here because we are not deciding your fate, it would be hard to judge from what you have told us. The bottom line is that in one LA your application would be approved, but in another it may be rejected. You may get to appear before a Licensing Committee & get the third degree to decide your application. If that happens, make sure you are not evasive, tell the truth, never get flustered, annoyed or wound up by them, because they will at all times be judging your character in such an interview as well as other things. If they approve your application they may also do so with a warning not to have any further cautions or convictions, 'or else'. Good Luck anyway; at least you have been honest, which is much in your favour. |

Yer i know i have been honest and upfront but its seems they love making you wait and know what you go through......... Just got a feeling this lot are going to say NO ! , why i dont know , thay just dont seemed arsed and do everything slow , i have waitied to get through everything since March 01 and cant see how after all this time knowing what they knew would be on the crb that only now they have to make a decision where as they could of done that a long time ago....... |

You'll be OK mate, you've been honest with them from the start and a caution shouldn't hinder you in getting your badge. Let us know how you get on. |

I suspect they are just checking with their boss, but I would be surprised if you are not given a license. They might give you a letter of warning, or maybe a six months license, but you should be ok. However please remain squeaky clean or else they will remove the license, should they grant it. |

Update - got to wait for a meeting now which i can attend in front of a commitee and put my case for them to make minds up ...... Got a feeling its gonna be a NO , not sure just seems a lot to do for a Simple Police Caution..... Wish me luck as they say they going to get a date asap. |

Look at it from their point of view. If they just give you a badge they may get accused of giving badges out willy nilly to anyone with a conviction. By going through the process of calling you to a meeting to discuss things, if they decide to then give you your badge they have covered their own arses.

Yep see they are covering there arse and agree 100% to that but cant get over its a caution and not a conviction. I am not asking for special requests but the manager keeps going on about Taxi law and convictions which seems to me thats the road they will try and go down.... Maybe i just worry to much lol.... And yer would be so easy to sign on dole , but never have in 43 years as always been in work and dont think i want too until i get really desparate. Thanks though guys |

I do think you are worrying to much. However a caution is given where you have already admitted an offence and from what you have put previously it was to do with dishonesty and the council will want you to show that you are in fact an honest person as the job intails money. |

It may not be a conviction, but to get a caution you must have admitted the offence. |
