 Post subject: can I ask.

A P/hire Min Bus Licenced for 8 passingers, as been book by a club on firday Satuerday Night.

It runs from town center to the night club, on a contract no money is taken by the driver?.

nither is any name and adress taken are for that matter no details taken at all of any passinger.

the whole thing just seem to me as wrong and this min bus look like its working as a bus.

I would be gratful for any information from any one who as dealt with this short of prvision from a p/hire firm before.

If they are picking up specific people for a specific job then it needs to be licensed. No money needs to be exchanged.

The only way it could be viewed as legal, i.e. without any licenses, is if that bus will pick up anyone that wants a free lift.

What they do is to park on the main street why staff from the club walk up and down the street, asking if any one would like a free transport to the club.

it just dont seem right

The staff much is touting, and the bus is illegal, if the bus hasn't a license.

if its Private hire and licenced for less than 8 passengers then it can carry out its contract quiet legally...if the club is the customer then they can dictate who the actual passengers are..nowt wrong in that.

Not sure it is licensed, and it appears if it is, then the booking conditions laid down by the act aren't being met.

I'm probably totally wrong but, if it's on a specified route, does it qualify as a taxi-bus?

It's not an area of legislation with which I've made myself familiar.

The vehicle is being used for reward; the club to which the passengers are being transported to is gaining the reward (of spending customers).

You say the PH mini-bus is licenced for 8 passingers & so it should be. Is the driver also licensed as a PH driver? If the club own the vehicle, under whose Operator Licence is the vehicle being used? Does the club have a PH Operator Licence?

If the club has a PH Operator Licence, then are the hirings being recorded as per the LA's Conditions of PH Operator Licence?

The club staff are clearly touting for reward (the club's reward of spending customers).

If the PH is picking up passengers off the street, without pre-booking, then it is acting as a Hackney Carriage, for which it is not licensed & most probably the driver is also not licensed for.

With regard to operating a vehicle for reward, a previous post on TDO highlighted a rural pub owner doing almost the same as this club & being prosecuted for operating a vehicle for reward by driving customers to & from his pub without the vehicle or driver being licensed.

If its not Licenced then its not a Taxi bus or a PH then...

the club does not own the vehicle, its contracted from a local p/hire firm and the driver is a licenced p/hre driver, the min bus is licenced for 8 or under.
