24th January 2005 - Stoke on Trent

Khan-v-Stoke on Trent City Council. The Appellant won his Appeal against the council's decsion to suspend his licence for 4 months on account of the fact that the council did not consider the Appellant to be a fit and proper person. One reason behind the council's decision was the fact that the Appellant had pleaded guilty in April 2004 to plying for hire in his private hire vehicle. The Magistrates upheld the Appeal but declined to award costs in favour of the Appellant. That said, the appellant was delighted not to have to face a 4 month suspension nor indeed any suspension, as the Magistrates do have the power to increase or decrease the punishment if they think fit to do so. From my view of this trade, if he did, then he wouldn't be that far off the mark. :shock:
