PLYING FOR HIRE ON PRIVATE LAND

Hello everyone I hope I am posting this in the correct place,I came across the site while searching for some advise on the above,basically the problem is this,a music concert as been held for the last 6 or 7 years approx 3or 4 mile outside of our licencing authority,there are no taxis in the town closest to the site which is on private ground the nearest being approx 15 mile away,the concert attracts upto 40,000 people with many of them arriving at the railway station in our town,allthough the people who run the concert put on free coaches to the site there is loads of work for us taxis,up until last year we have had no problems taking and fetching back people to the site,we were told by our Licencing Officer that because its on private ground we could ply for hire there after dropping off,people would wont to go into town to get food etc,or go to a differant entrance as the site is well spread out.This year the drivers from the Licencing AUthority in which the concert was held got their Licencing officer to move us saying we were ilegally plying for hire allthough we were on private land.I would very much like to hear your views on this.Sorry I,ve gone on a bit this being my first posting on the site.

'It depends on what the bylaws say' is what I usually get told and will probably be as useful to you as it was to me :wink:

I do think however there is a case on here relating to this and I'm sure somebody will post a link for you at some stage

If the non-local taxis are away from the main road, or as the legislation says 'street', and local people from the area haven't got free access to the site where you lads rank, then you are acting within the law. As long as you have got permission from the land owner.

What I would ask the LO is exactly what offence he is accusing you of. If it's plying with the required license, then point him out Young -v- Scampion. :wink:

you're wrong :shock: ..... in my opinion.... it depends which Act's council has adopted, for instance Sefton and Liverpool adopted the Merseyside Act.... which give the ability to enforce licensing on private land within the their licensed area.... :oops:

Errm......I know your new, but what if all the cabs from the area you went to had to come to your manor this weekend and ply on private ground?

There are members on TDO who have major issues with cross border hires.

It does seem that this is a grey area within the law with some people quoting one case in our favour someone else quoting another case against us,as for other Taxi,s coming into our patch and plying for hire on private land I would have no problem if it was legal for them to do so,problem is no one seems to know whats legal and whats not.

What then Sussex would you advise our next move should be as our licencing authority will not back us in any way,even though it was them who told us we could ply for hire there in the first place.

No problem Skippy but you shouldnt have to do it that way the law should be one or the other but we cant seem to find out who is right and who is wrong.

Provided the land-owner agree's......and if they've got any brains at all they'll want to stay on the right side of the local authority.

Have a word with the old bill and ask them if they have any objections preferably an inspector and explain that you have done it for years and are you free to carry on

What council is next door?? and is there taxi inspector seen at night, or over the weekends I would at a guess think not
