 Post subject: Legal eagle help please

A local firm runs executive cars but doesnt license them. :sad:

They say they are run under the 1976 exemption. But I thought that was for contract work only. :?

What they do is sign up the posh cars to a contract with the cab firm for a year or so. So any work is just for the cab firm.

Is this right?

yes it probably is right,

rules are there to be followed and they are following it to the letter

and they can even have peodephiles as drivers too.

I think the current view is that for any exemption under section 75(1) (b), the contract must be for a specific vehicle (one contract = one vehicle), not one vehicle doing many different exempt contracts, the contract should have a defined lenght that must be more than seven days, and should also have a specific notice period of termination.

To answer your question Mr Cgull, I think your local operator is taking the p***.

I hope it's not the one that's managed by the local T&G man. [-X

The London wording is slightly different from the rest of us, but in London it is at the moment legal. However the DfT are trying to make it illegal. \:D/

For the rest of us, it's legal until a court says it isn't, which pretty well sums up the 1976 Act. :sad:

But there could be light at the end of the tunnel. \:D/

I can't see how the DfT can sort out the London problem, without at the same time sorting out the 1976 Act problem. An announcement may be due soon. :wink:

Yesterday we heard the man called Cgull. He, of course, is a driver. He said, more or less, that the T&G man and his mercenaries, were running illegally. You answered that they are probably legal. The licensing officers are in position to deal with these people if they are acting illegally. It was claimed that the person operating the union was involved in this operation. I say that the unions position is such that his members would not permit such a misappropriation. You then went on to insult me, you are not worth an old shoe.
