So, is there any thing written down to say you can, can't pick up, drop off any were? well exept the obvious zig zags bus stops, green cycle lanes etc, if not what are you expected to do if were you are picking up, dropping off is restricted by yellow lines, no waiting restrictions?

You can stop on a Bus Stop for the minimum time to load or unload passengers in a Hackney.

You can not stop on a Bus Stop at all in a PH or private vehicle.

What about a road that has double yellows and no waiting cones that have been put out, this is a race meeting! would these restrictions affect all vehicles, including buses Qing to get to the shuttle bus pick up point and out of town taxis/private hire vehicles?

As far as I know you are allowed to stop to pick up of set down passengers for as long as is reasonably necessary.

I have in my pocession a letter sent to a member of the public last year regarding PH picking up and putting down passengers on a taxi rank.

The body of the letter is as follows:-

Further to your telephone conversation of 17th September with Mr B***** concerning the use of the Hackney Carriage Rank in Liscard Crescent, Liscard.

I can confirm that the 'No Waiting Except Taxis' Order that governs this particular rank allows for setting down and picking up of passengers.

I can also confirm that I have discussed the matter with the Parking Services Manager who has informed me that vehicles parked within this area are subject to a 3 minute observation period before a Penalty Charge Notice (PCN) can be issued. Therefore should you be waiting at the kerbside for a private hire vehilce to collect you then it is quite legitimate for the vehicle to stop if space is available and for the driver to help you into the vehicle. However, should the vehicle be waiting in the rank for you or any other passenger to arrive then it is likely that the vehicle will receive a PCN should it be observed waiting for 3 minutes or longer.

I hope this clarifies the situation

Now I know it's not quite what you were asking, but, it is written down :lol: I was wondering when I read this that if it was 'legitimate' to do this on this rank is it 'legitimate' to do it on any rank here :wink:

If vehicles are in a queue of traffic that is moving, albeit very slowley, towards a destination I can't see how this could be deemed to be "parked" or "stopped". However If anyone was to pull right to the kerb and stop to pick up passengers, this could be seen differently.

Seriuosly though . . . . that's not what the legislation says.

The only vehicle that can legally pick up & set down on a taxi rank is a PSV, AND then only as the Act says, 'it shall be a defence to show that, by reason of obstruction to traffic or for other compelling reason, he caused his vehicle to wait on a stand or part thereof' AND to set down or pick up immediately. They cannot wait for passengers to arrive on the rank to load; the passengers must already be there waiting & the PSV must unload immediately & move off immediately when loaded or unloaded.

No other vehicles are allowed on a taxi rank & the fact that traffic wardens in the area quoted as in our area are a law unto themselves does not make it right.

LG(MP) Act 1976 states;
64 Prohibition of other vehicles on hackney carriage stands
(1) No person shall cause or permit any vehicle other than a hackney carriage to wait on any stand for hackney carriages during any period for which that stand has been appointed, or is deemed to have been appointed, by a district council under the provisions of section 63 of this Act.
(2) Notice of the prohibition in this section shall be indicated by such traffic signs as may be prescribed or authorised for the purpose by the Secretary of State in pursuance of his powers under [section 64 of the Road Traffic Regulation Act 1984].
(3) If any person without reasonable excuse contravenes the provisions of this section, he shall be guilty of an offence.
(4) In any proceedings under this section against the driver of a public service vehicle it shall be a defence to show that, by reason of obstruction to traffic or for other compelling reason, he caused his vehicle to wait on a stand or part thereof and that he caused or permitted his vehicle so to wait only for so long as was reasonably necessary for the taking up or setting down of passengers.
