Can anyone help me?

Have I got the right answers for these Birmingham Knowledge questions?

Also, I don't have an answer for 5 or 8.

Any help would be gratefully received.

1 – A POTENTIAL HIRER HAS INSUFFICIENT FUNDS. WHAT MAY YOU DO?

REFUSE THE HIRING, OR AGREE TO TAKE THE HIRING FOR THE AMOUNT WHICH THE HIRER CAN AFFORD.



2 – CAN ANY VEHICLE OTHER THAN A HACKNEY CARRIAGE WAIT ON A HACKNEY CARRIAGE STAND?

ONLY A PSV, AND ONLY IF HE WAS FORCED TO DO SO BY NOT BEING ABLE TO STOP AT ANOTHER REASONABLE PLACE, AND ONLY FOR AS LONG AS IT TAKES TO PICK UP OR SET DOWN HIS PASSENGERS



3 – CAN ANYONE DRIVE YOUR HACKNEY CARRIAGE VEHICLE BESIDES YOURSELF. IF SO UNDER WHAT CIRCUMSTANCES?

YES, IF THEY ARE LICENSED BY THE LOCAL AUTHORITY AND INSURED TO DRIVE THE VEHICLE IN QUESTION.



4 – CAN YOU CARRY ANY ONE OTHER THAN THE HIRER? I.E. TWO PARTIES FOR ONE JOURNEY.

YES, BUT THE PARTIES MUST DECIDE WHO SHALL PAY WHAT PROPORTION OF THE FAIR, NOT THE DRIVER.



5 – CAN YOU DRIVE YOUR HACKNEY CARRIAGE VEHICLE IF A SEAL ON YOUR METER HAS BEEN BROKEN OR BEEN REMOVED AND WHAT MUST YOU DO?

6 – CAN YOU REFUSE TO TAKE A HIRING FROM A HACKNEY CARRIAGE STAND? IF SO UNDER WHAT CIRCUMSTANCES?

YOU CANNOT REFUSE A HIRING WITHOUT REASONABLE EXCUSE UNLESS IT IS GOING OUTSIDE THE PRESCRIBED DISTANCE.



7 – IF A HACKNEY CARRIAGE VEHICLE IS INVOLVED IN ANY ACCIDENT WHICH CAUSES DAMAGE MATERIALLY AFFECTING THE SAFETY, PERFORMANCE OR APPEARANCEOF THE VEHICLE, WHAT SHOULD THE VEHICLE PROPRIETER DO DO?

INFORM THE LICENSING AUTHORITY AS SOON AS POSSIBLE AND WITHIN 72 HOURS OF THE ACCIDENT AND IF ASKED BY AN AUTHORISED OFFICER, PRODUCE THE VEHICLE LICENCE AND CERTIFICATE OF INSURANCE AND MOT



8 – IF A JOURNEY FINISHES OUTSIDE BIRMINGHAM BOUNDRY, WHAT DO YOU CHARGE?

9 – PLEASE STATE WHAT THE RELEVANT ACTS OF LAW ARE IN RELATION TO THE FOLLOWING. IF A DRIVER TRANSFERS HIS/HER INTEREST IN A HACKNEY CARRIAGE VEHICLE, WHAT SHOULD THEY DO?

UNDER SECTION 49 OF THE LOCAL GOVERNMENT MISCELLANEOUS PROVISIONS ACT 1976 A DRIVER WHO TRANSFERES HIS INEREST IN A HACKNEY CARRIAGE/PRIVATE HIRE VEHICLE MUST INFORM THE COUNCIL WITHIN FOURTEEN DAYS, IN WRITING, STATING THE NAME AND ADDRESS OF THE PERSON TO WHOM THE VEHICLE HAS BEEN TRANSFERED



10 – WHAT DUTIES DO YOU HAVE IN RESPECT OF A BLIND PERSONS GUIDE DOG (OR DEAF PERSONS HEARING DOG)?

YOU ARE NOT ALLOWED TO REFUSE TO CARRY A BLIND OR DEAF PERSONS DOG.



11 – WHAT IS THE PRESCRIBED DISTANCE?

THE PRESCRIBED DISTANCE IS THE AREA IN WHICH YOU ARE LICENSED TO PLY FOR HIRE AND ALSO THE AREA FOR WHICH YOU MUST ACCEPT HIRINGS UP TO, USUALLY THE BORDER OF YOUR LICENSING AREA.



12 – WHAT IS THE WAITING TIME AND WHAT OBLIGATION DOES IT PLACE ON A DRIVER?

THE METER CLICKS OVER BY TIME WHEN THE HACKNEY CARRIAGE IS NOT MOVING. THE DRIVER OF A HACKNEY CARRIAGE MUST NOT PURPOSELEY PROLONG A JOURNEY BY TIME OR DISTANCE.

Also.

Can a Hackney Carriage stop on a bus stop for the purposes of setting down and picking up passengers?

2. Dunno
3. A tester or mechanic (in some areas, in some not) and (i bet) a policeman
4. yes
5. No and inform your LO
6. Yes, if the passenger has a dog (not a seeing eye dog)
7.
8. Any agreed fare

You can drive the vehicle, just can't take any work until the licensing officer has re-sealed your meter.

What you f***ing well like, providing you have quoted that price prior to pulling away. If not the metered rate must be charged.

SI 3113 of 2002, Regulation 29, schedule 19, para 4 (d)

And in all its glory...

(d)a taxi which is stationary only for so long as may be reasonably necessary for a passenger to board or alight and to load or unload any luggage of the passenger;

That is great, thanks.

Don't suppose we could stop in disabled spaces for the purposes of loading/unloading disabled passenger?

It would be Good if TDO could publish a printable version of the key points of taxi law that we could all keep in our Cabs. Policemen don't seem to know anything about the law, and it would be very helpful to carry a booklet stating the law in relation to fare evasion (that's a civil matter mate, we aren't a dept collection agency). Picking up and setting down and anything else that could be useful.

Just a thought, and I haven't the brains to be able to find this stuff myself.
