 Post subject: Hackneys and boundaries

Can anyone enlighten me on the rules or bylaws about Hackneys operating outside of their licensing authority?

I know they can't rank or respond to flag downs outside of their LA, but can they respond to phone calls in areas outside of their LA?

For example, if I got myself a Ribble Valley Hackney, could I still pick up a phone booked job in Preston's LA even if the fare/journey wasn't entering the Ribble Valley district?

The reason why I ask is...

I don't live in Preston's LA, but I do drive a Preston Hackney. If I was to switch to the authority where I live, could I still service my clients I have built up while working in the Preston LA?

Prebooked as in they ring my mobile. I won't be setting up an operators license or anything like that, just a Hackney driver. Where would I have to log the details? Is the call registry in my phone enough evidence?

Currently I simply receive a call, take the job on and pick them up. On the rare occasion a fare starts and ends outside of my LA, have I already broken the law with that?

Probably, but get a notebook and write them down anyway. It won't hurt.

Is that a byelaw? Does every LA have one like it?
Does it apply to hacks as well as PH?

I currently have quite a lot of phone work, and on busy nights I can be restricted to 1 or 2 rank jobs as my phone is sometimes red hot.

I could simply switch to PH in Preston LA, but then I'd either have to join a circuit at extra cost for the radio or set up my own operators license.

I'm looking to do this change to avoid the high rent of £210 per week for the Hackney I rent, so saving on that and then paying a firm for a radio doesn't make sense.

Hackneys, as far as I'm lead to believe, do not need a OL to take private bookings, so that's why I'm looking into getting a Hackney plate from a LA that doesn't have a cap on them. The only doubt I have is what I posted in the opening post, and that's the legality of carrying out private bookings in a different LA than the one on my plate.

Does any HC drivers here do cross border bookings already?

Yes, particulary those licensed in Berwick :roll:

They may, or may not apply to PH, but it can never apply to HC as there are no HC operating provisions in any act.

In other words no law, therefore no breach is possible.
