Sorry if this has already been covered.

We have a situation down here whereby Hacks from other boroughs are parking up in our manor ( I believe with no actual pick up booked ). They are waiting for a call from their home base to say that a booking has been made, the booking then takes place and they are then in position to pick them up.

What is the legal position re this situation? as they are taking work from another borough.

If they are parked with their lights off then basically they are parked. No laws broken.

If they are parked with their lights on then they are illegally plying for hire, thats how I understand it anyway.

As has been mentioned if they are viewed as plying, then that's illegal. If they are viewed as waiting, then that's not.

It all depends on the situation at the time.

In other words if they are waiting very near to an official rank, or outside a busy nightclub, then IMO that's plying.

If they are waiting in a car-park out of the way, or out of view of the public, then at present that's legal.

The recent case of Fidler concurs with the above.

We have two lots from out of the Borough, at different ends of the City centre.

The one lot wait under a bridge just outside the rear of the Central train station, and the other lot park in a main street i.e clubs pubs etc by the entrance (but not in) of a Hotel. The entrance is shared, leading to night clubs/bars etc. The punters also seem to use the Hotel steps and the area in general as a waiting zone to be picked up by booked (out of town) taxis, and also those who wait (again in the same area) for an out of towner (not booked).

Then pressure needs to be put on the council to do some mystery shopping.
