I was having a discussion yesterday in regard to using my meter when outside of my licensing district. I know that any journey undertaken inside my Licensing district requires me to use my meter but I was under the impression that if I was going out of my Licensing district and had agreed the fare before embarking on the journey than the requirement to engage my meter was non existent. I have however been told that I must use my meter for EVERY journey regardless where it starts or finishes. We have the following condition attached to our License which I think corroborates this as I would hardly be likely to charge more than the metered rate if the meter was on. 3.4 The driver when driving a Hackney Carriage Vehicle shall not, when undertaking a journey ending outside the District, take a fare greater than that recorded on the face of the taximeter UNLESS A FARE WAS AGREED BEFORE THE HIRING. Is there any legislation that would confirm this one way or the other. |

Is there any legislation that would confirm this one way or the other. We never put the meter on in Brum when a fare has been agreed that is terminating outside our licensed area. On a technical point, I would suggest that your conditions should in fact be bye-laws for drivers, as conditions can only be placed on the proprietor of a Hackney Carriage. Also, being pernickety, the word 'take' should in fact read 'demand'. |

For work outside of your licensing district you can charge what you like. Sec 65 (1) of the 1976 act only permits a council to set fees for within their licensing district. Sec 66 (1) of the 1976 act says you must use your meter if going outside your area if, and it's a big if, you don't come to an agreement on the fare before you depart. Thus the council have no powers to make you use your meter outside of your licensing district. |

You can legally ask for payment up front as well on all runs outside your area this stops the chance of a runner |
