Post subject:  HOW TO CON A COUNCIL

Wycombe District Council issued 8 New licences to go specificatley on new TX2's December 2003 by March 2005 of those 8 new WAV's we now only have 2 left the other 6 have sold the vehicle's invested in top quality £3000 saloon cars and the coucil have let them get away with it. The original condition that these licences were issued on said that they could not be traded for 5 years and if the drivers were to pack up the trade the licenses would have to go back to the council These drivers are now saying this is an unfair rule and they want to be able to sell there vehicle's like anybody else. meanwhile our town now only has 3 wav's and were back to struggling to cover wheelchair work. The council appear to be doing nothing about it :sad: :sad: :sad: :sad:

The problem is such a condition is/was un-lawful.

I suspect those lads that got the plates either knew that, or were advised that. Bournemouth have, or up until recently had, a similar un-lawful condition. :shock:

But surely the point is that they've breached the license by putting on saloons, so why did they get away with this?

I don't think this aspect has been tested in court, has it?

Lincoln City Council made black cab (or similar?) a condition of license in 1994. Two owners won a stay whilst applying for a judicial review, but this was rejected by the high court in London.

To my mind, the only fairway (pun intended) is either WAV or not. how can it be fair for one owner to have to put on a WAV whilst another puts on a saloon. Level playing field please. (exept Chelsea's obviously)

It becomes fair when the council changes its policy. The council dictates what is to be a hackney carriage. Come to Manchester we have a discriminatory policy, we discriminate against saloon vehicles becoming Hackney carriages. Get with the program, if a council says no more saloons then no more saloons it will be. Simple as that.

Ask Chris Rowlson at Mansfield Council you seem to be good buddies with him he'll explain it all to you I'm sure of that, after all he likes the brown packages.
