Taxi Driver Online

One of the boroughs taxi drivers has received a fixed penalty charge notice for 75.00 from our local council sent to him through the post, stating on a particular date and time he was spottted by a council officer discarding a cigarette on the floor, they have stated in the letter they got his details from the taxi licensing dept and has 14 days to pay.
Has anybody ever received one of these and how can it be proved that it was actually him any comments on this matter wouldd be appreciated

The LO will have noted it, and the driver is fully entitled to see the evidence against him.

Then he will have two choices, pay the fixed penalty or challenge it in court.

Should he lose in court he will have an increased fine and several hundred pounds worth of cost.

However all this is quite simple to sort, if the driver didn't do it then he needn't worry about this, however if he did then he will have to pay up.

He should Ask for photographic evidence, as he cannot remember if he was in the area at the time of the alleged offence, and until he sees it he is making no comment

Always ask for evidence, they probably do have it, but just in case it's a chancer bust he should ask to see it, I would say it needs to be video myself as anyone can take a picture at any given time.

A simple reply, I don't smoke, that should feck them up

Surely it would be impossible to prove that a smoking taxi driver didn't "discard his cigarette on the floor"?

Why?

Don't cars have ashtrays anymore, thing is he's on a loser both ways, if he can prove he didn't ditch the butt he then gets it in the ass for smoking in the cab.

How long before council workers are required to raise their arm in the air and shout something in German.

Lucky not to be done for Littering as well as smoking.....

Once again, evidence. As I've mentioned before is the word of a council officer enough to secure a conviction without supporting proof ?

Times are tough and could be a nice little earner for a LA to go round making up allegations of littering at £75 a pop. They don't have to prove anything, just say they saw you dropping litter ! On the other hand, if a (different) taxi driver said they saw the same council officer dropping litter and reported them to the LA would that officer get a £75 fine ?
