Hi when a HC works for a company as a Self employed owner Driver can they charge the customer the booking fee as stated in the council tariff if the job was given to them over the companys radio and it is not from a rank?

but can the driver charge it as our LO said no because it was made through the company and not with the actual driver? |

Our table of fares forbids the addition of a booking fee on any HC fare that is within the Borough. |

A booking fee may be added to the table of fares under section 65 of the 1976 Act; Fixing of fares for hackney carriages. 1)A district council may fix the rates or fares within the district as well for time as distance, and all other charges in connection with the hire of a vehicle or with the arrangements for the hire of a vehicle, to be paid in respect of the hire of hackney carriages by means of a table (hereafter in this section referred to as a “table of fares”) made or varied in accordance with the provisions of this section.. I would suggest you LO is wrong as the telephonist is acting as your agent. CC |

Your LO is wrong. |

So basically the only time it would apply would be when the driver takes the call personally? Doesn't seem right. In fact taking the argument to its logical conclusion, should the driver be able to charge any fare at all if he's working for an office? So has your LO outlined the circumstances under which the fee can be applied? |

Thanks all for help and advice given on this subject. LO has now admitted we can charge a booking fee.
