| Post subject: | Judicial Review; HC and PHV Licensing Penalty Points |
Rumour has it that two Cardiff licensed lads are aggrieved that they have fallen foul of the dreaded licensing penalty points system and are seeking judicail review on whether councils have the legal right to introduce such systems. Apparently the rumoured judicial review is listed for hearing on 22nd and 23rd May 2012. Another one worth following. |

To a degree yes, but if there is a disagreement over time listings will allow that to be debated in front of the judge. The point I'm making is that if it is within time, then those drivers have engaged in those activities very soon after the policy was implemented. If that's the case do we really need that sort in the trade? |

You can object when the rule is brought in (within time), then you can object when it directly affects you and the clock starts again from then. |

Had this system here for 20 years now, I don't know why drivers worry about it, it's not on your driving licence, no fines just the ability for the council to keep a record of who breaks the rules most and to be able to lock n' load a reason to get shot of said unsuitables. |
