Hi, i have been a private hire driver for 16 years now licenced with dudley council.Last year i went abroad for 3 months, when i returned in April it was a long bank holiday with the royal wedding, so i couldnt get my medical on time, my licence was still running untill june, the council revoked my licence and i had to apply as a new driver this involved me taking a DSA test, i also had to re-take my knowledge test, putting me out of work for 13 weeks, i was denied the right to go to comittee as i wasnt a licenced driver anymore. I am now in the process of taking the council into small claims court, but dont think this is going to be easy to win.....has anyone any advice please? I have always held a clean licence and have never had any convictions within the trade. I believe this to have been a grudge against me from the licencing officer!

The council had, IMO, no grounds to revoke your license.

They licensed you to June, the fact that you didn't take a medical is irrelevant, unless they suspended your license until you took if following information they received.

Not sure the small claims court is the place to go, I would complain to the Local Government Ombudsman, who if you win can ask the council to compensate you.

But you should have had the medical.

I would have thought that when your license was revoked that you should have had the right of appeal at that stage. Why were you not able to appeal at that stage?
