Post subject:  defect rectification notice (21 days)

Very worried need some advice please.

Just been granted my taxi badge but was given a warning due to the fact that i had some criminal convictions dating back to 2007 and previous. Now got a clean license, LGV license, private hire taxi badge, two years no claims bonuses + fully insured, Mot'd, taxed and roadworthy vehicle.

As soon as i got my badge i applied for my Hackney badge costing £91 + £400 for lessons and also went to the bank for a £5000 bank loan which i got accepted for to which i spent £1567 on a taxi plate for my own private hire taxi and £5000 on a 2008 peagout 407. In total i have invested over £7000 at same time as keeping myself rehabilitated.

Was absolutely delighted that i had finally got my life back togethor and now a good citizen and made a deal with a car tradesman in glasgow that he would part exchange my current car for the 2008 car which will hopefully pending the approval of my plate be soon ready for examination. In the contract is a deal whereby the deaaler will agree to take responsibility for repairs should the vehicle fail.

The other night i decided to go out with my friend in my car to go to the garage and give the car a clean as it was due to go to Glasgow in the morning for part exchange and also we decided we would go take in a couple of taxi routes given to me as part of my lessons when on the way to the garage i got flashed by a police car whom pulled me over telling me my registration light was out and proceeded to check the car for further defects to which i was devastated and shocked to find that both my front side lights where out.

This was a shock to me as this must have been something just happened this evening as the side lights had previously been in good working order, and as for the registration light this was something may have escaped my attention while making sure everything is legal and above board as in all my training for lorries and all my time driving it has never came to my attention while checking break lights, indicators, head lights, tail lights, side lights, to check my registration light.

The officer was happy this was minor defects could have happened while driving but instead of giving me advice chose to issue me with a VDRN which gives me 21 days to take the car to an MOT centre, get the car repaired, and take the repair stamp to the police station as proof the car has been rectified.

It was nearly 1am in the morning and i am aware the real reasons behind him not letting me off with friendly advice was to justify the next thing he did, which was pull out his breath test machine, to which i breathed in and scored 0 meaning i was 100% free from alcohol.

due to this notice however i was unable to go to glasgow and pick up the car and the dealer is currently on my case wondering how long the car will be in glasgow.

I have had the car repaired and stamped and taken to police station but am now devastated and worried sick.

I am no longer doing my lessons and am worried that this VDRN may effect my application for taxi plate and hackney carraige application and the police now may put in an objection to which is something i have already invested over £7000 into and got myself indebted to the bank for 3 years over.

Despite the fact i have a warning from the council not to reappear before them again and a criminal history to which all rehabilitation periods are spent, no amount of rehabilitation will ever make me rehabilitated enough to take responsibility for a side light that must have went out while i was driving and i had no way of knowing it was out as my head lights and dip lights where fine.

will the VDRN give the police reason to object?

Nothing to worry about, you've changed the bulbs, had the ticket stamped and shown it to the police. End of matter.

If you panic this much about such a minor thing, what are you going to be like if someone makes a complaint about you?

Chill out. This will never find it's way to the council.

Agreed, worrying about nothing.

One thing I might comment on is that as a lorry driver were you never told to do a daily walk-round check of the vehicle before you took it out? It is one thing that is now drummed into operators and drivers of PSVs and HGVs; VOSA are [edited by admin] on that sort of thing. It's worth doing a walk-round check on your car even if it's every other day, it can save a lot of aggro. good luck.
