Post subject:  Out of area vehicle spot checks.

Could anyone please clarify the law on licensing officers from a different local authority performing spot checks on vehicles/drivers. I was stopped at Mcr airport this morning by a manchester city lo, I am badged in Bolton. Help & advice please.

My problem is that I believe that the licensing officer has no jurisdiction because I am not badged in his area.

You may well be correct but why cause trouble when it isn't necessary.

Depends if VOSA and the Police were out with them.

We've had plates removed by an adjoining Council when they've had an enfrorcement drive.

Why should I let a council take the moral high ground whilst quietly ignoring the rules. Is this not how HC/PH drivers have ended up being dumped on constantly?

What if...you'd been operating illegally? Would you like an unlicenced "minicab" to be inspected and let off?

Rother Valley often do spot checks in Rye on cars from all areas.

If your car was "clean" and legal, why worry? 8)

Not sure about Bolton and Manchester, they do work together through AGMA - a question for your LO I guess

Some councils have joint agreements with neighboring areas, but in general they can't check you.

Email (FoI request) Manchester asking what legal powers they have to check a vehicle not licensed by their council.

For the record it would pi** me off as well, not because of the check but the laissez-faire attitude to the law.

Did they stop you without VOSA or Police present, or were you already stationary when they approached you?

If they were not accompanied by VOSA or Police and you were stationary when they approached you, why didn't you just drive off?

As I told my LO recently, it is for the council to obey the law, not to interpret it. That is the job of the courts.

how would 1 LA prosecute an out-of-area HC or PH when the rules are fragmented and implemented differently in each LA?

i need a white saloon for hack plates here, the next LA requires black WAV's ONLY, so.......

I would have thought that with most laws being quite vague that it was up to the council to interpret the law. It would then be up to someone who thinks that the council are wrong to challenge that interpretation through the courts.
