Post subject:  bad back and honesty

Hi taxi Driver twenty years 14 saloon car six years wav gave up wav because of lower back problems to protect what spine i have left on recommendation of doctor and surgeon 70% of my work wav wiped out sold my wav asap lost £10000 pounds on the sale because i felt i could not sit in a wav vehicle at the time the only one for miles and not offer that service . bought saloon car licence hackney Or taxi now things are changing the trade or licence department say future 100% wav for taxi,s . I have asked three times and been told different answers where do i stand first on the phone licence officer said he should not be taxi driver okay . Taxi licensing committee licence office present asked same question how do i stand i can not push heavy weights lower back problems licence officer stands up and said exemption okay now that licence office has left i am told in future i should go private hire because the present licence officer say they have no intentions of giving any exemptions so as a taxi driver i feel future is looking a bit short lived 56 and was hoping to carry on to retirement so honesty dose not pay you buy the wav and say your to busy ? i am sorry i have never worked like that

So your area demands WAVs for hacks, so youll either have to plate private hire or jack in

As mentioned you can go PH.

However if that doesn't float your boat why not get one of those saloon type WAVs like the Partner?

If your council is questioning your ability to do the job, then apply for an exemption for WAV work, which is entirely allowed under the old 1995 DDA, and the new 2010 Equalities Act.

Your could also ask to see the taxi licensing Equalities policy, which I very much doubt your council has. :-$

hi i am sorry for some of the way i write I'm dyslexia it dose not mean I'm stupid i just really struggle to put things together at times . i have been like it all my life i only found out what it was though having to do NVQ the person that took the NVQ course taught kids with dyslexia . So my job prospects are very poor i think bad back and Dyslexia i have never missed a days work since 15 when i left school . The way the licence department talks if i buy the wav they will not issue any exemptions to anybody i feel that stops my right to work really the reply was your can not do the job go private hire .We as a council will not give out any exemptions you will not go though the medical that is coming out in the future is the reply thanks for your replays and i apologise for sentence and spelling i try and hope the computer helps if i wrote this down i can,t even read it myself thats how bad my dyslexia is it takes my a long time to put an Article together i hate it

If you write to your licensing department asking for an exemption from pushing wheelchairs, they must consider your request.

They can't just refuse all applications. Disability rights apply to taxi drivers as well.

Thank you for these answers i have read article 2010 Equalities Act and Read law commissions reference to it on page 220 i can not see on what grounds they can refuse me a licence thanks for this information

WRITE TO YOUR COUNCIL AND ASK FOR A EXCEPTION WHEN THEY REFUSE ASK FOR A GRANT TO BUY A WAV WITH A TAIL LIFT.

No.

In my manor a number of WAV drivers have exemptions.

well things have moved on licence department said no exemptions i can look at this as i have to go private hire after 20 years taxi service . i drive down the road rural area i see customer stood in the rain i currently can stop if requested and take them as i have for twenty years. in the future i will just have to drive past like a hoarse with blinkers on ignore customers of twenty year . Or i buy wav vehicle i pull up open the doors lay out my ramps assist to the point where i am asked to push wheel chair customer up the ramp and refuse on grounds of my own health and safety i can't put my self at risk would i be in my rights thats the question . would my licence be revoked and on what grounds i would rather have exemption because i would not deceive customers but the license department says no exemptions

Im not so sure you have to do more than accept a wheelchair job and offer the customer the ramps do you?

You need to seek professional help as your council are quite simply wrong.

Or complain to the Ombudsman.
