I think he means a driver leaving his hackney unattended whilst on a rank.

I mean....I left my taxi/hackney carriage on the 'taxi stand' whilst in our 3 mth meeting with the licensing department and myself, and two other taxi/hackney carriage drivers returned to our vehicles to find we had all got parking tickets. We had parked on the STAND not the RANK. The stand is for hackneys not for hire.
So my question is...where can i find the relevant legislation regarding the difference between ranks and stands as we want to appeal the parking tickets but need the proof

Hope thats clearer

I wasn't aware there was a difference - ranks are described as stands in the 1976 act - section 63 and 64

section 68 of the 1847 act allows a local authority to set byelaws - this uses the term stands "For fixing the stands of such hackney carriages, and the distance to which they may be compelled to take passengers, not exceeding the prescribed distance"

I don't believe there is such a thing as a stand for taxis that are unavailable for hire.

Was this on Network Rail property or the public highway? If Network Rail the tickets are PPC tickets and can be safely ignored, see the Pepipoo forum for details.

If the public highway, check out the Traffic Regulation Order for that road. You can usually download that from the LA website.

Send a FoI for the bye-laws.

Have you tried getting a copy of the Traffic Order for the road?

You can search for TRO's here;

http://www.trafficpenaltytribunal.gov.u ... mentID=139

Although not every TRO has been submitted to the site. Try searching Google for 'traffic regulation order' + the name of your borough/town/county and see if anything comes up.
