 Post subject: Class 2 DVLA medical.

One of my colleagues had a meeting with the local authority regarding our concerns over non-UK applicants being able to circumvent the full medical requirements of their application.
My colleague subsequently wrote elsewhere:

" Applicants are required to have the Class 2 DVLA Medical carried out by their own doctor because he/she has your medical history. Additionally doctors in the UK know the guidelines laid down by the DVLA and sign that they have used the guidelines to complete the form.
Applicants from outside of the UK usually have their medical completed in their home country by their own doctor who has their medical history but probably has not read the guidelines laid down by the DVLA, even though they sign to say they have read them. One guideline is 57 pages long.
Some non-UK applicants have their medical in this country a short while after arriving here, so the UK doctor knows the guidelines but has no medical history.
The [medical opinion] Centre is [LA's] independent medical experts they admit that doctors from outside of the UK have probably not read the guidelines, they say that with their expertise and possibly more tests they can decide who gets a licence.
Licensing Officer admits that the situation is not perfect but he is under a requirement to be ‘reasonable and proportional’ and if he refused a licence under my complaint there would be an appeal and the appeal would be upheld and the applicant would get the licence.
I have already discussed this with a Councillor and with the local MP who wrote to LO's Boss, who instigated my meeting with LO.
I shall write again to MP."

Any ideas on the legal issues we should be throwing back at them? Any other comments? Has anyone else come across this situation?

Not sure there is much to add. :sad:

Other than maybe a more frequent medical retest, although I doubt that will be popular.

But is all this really a problem?

The medicals we do down here will pick up most things in the test, and if anything comes up iffy we will be referred to a consultant.

Surely that will happen wherever the driver comes from.
