Hi All, Recently I have had an issue concerning my plates, I had forgotten to renew them, after this was resolved I have now been told that my Insurance was Invalid during the time my plates were out of date, even though I was fully Insured at the time and it hadn't ran out. I now have to go to court. Can anyone tell me if they have had a similar incident and if they know if this is true about my Insurance being Invalid during that period. Would really appreciate any feedback. Thanks Darlocabbie |

It may (and often does) have a clause on your insurance to say that you must abide by Local Authority regulations. This would include being in date for both Driver and Vehicle Licenses. |

I would also ask your insurance company - if they confirm that you were insured it makes the court case pretty pointless. |

As far as I am aware you are covered for social and domestic BUT NOT for use of the vehicle as a taxi IF you do not have a valid plate i.e. it was out of date if the vehicle was withdrawn from the road and not in use as a taxi/ph then you should not be in court however if you were using the vehicle without a valid license then you MIGHT have been inadequately insured BUT check with your insurers they do not all work to the same rules. PS does the council have evidence of the vehicle being used whilst being out of plate ? |

LV used to insist i forward plate detail as and when or i wasnt insured are you with LV? |

It depends what your insurance says. It is down to insurer and the policy wording. I suspect there's nothing in the policy that will invalidate the policy for road risks up to fully comp, but may not cover you for hire and reward element while your plates were out of date. After all, you "could" have failed the compliance; plates get taken off, you have to drive to a main dealer to get the car fixed on warranty. Are you insured? Answer probably yes. I'd also suggest that as your personal badge hadn't run out, YOU were still insured anyway to drive for hire and reward, if not in that car which may not have been covered for H&R during the time the plates were out of date. Get yourself a motoring lawyer, or you may face 6 points and a hefty fine. |

If they say yes then you was covered and can't be convicted of a traffic offence. If the council are bringing separate by-law/license conditions offences, then you could be in trouble. |

If you where licenced at the time but only the date on the plate had expired you where still insured, WTF do councils put expiry dates on bits of plastic, why can they not just issue a plate for as long as you need them If it goes to court you should ask the judge to inform the council not to put expiry dates on plates Whay council is this BTW??? |
