We're very reasonable and flexible. If we receive calls in volume, we will simply increase the times and frequency.

You have to understand that we are also busy at Courts on a daily basis so we physically cannot sit on a phone all day. This is a free service.

As some of you will be aware our firm and specialist solicitors have long represented driver (both Hackney and Private Hire) across the country for many years.

The legislation as you will be aware is vast and cumbersome to say the very least. It is further complicated by each Council having its' own bylaws.

While many of you may have Union representation, we are finding a large majority who come through our doors do not.

We are now piloting a free legal advice line where all initial consultations will be free. We know of others (non lawyers) who charge for initial consultations. So feel free to direct your questions concerning suspension / revocation / Appeals to Sub Committee / Magistrates and Crown Courts to us.

Andy - As for the electronic cigerette issue - WOW. Without researching the issue my gut feeling tells me the following:

As we all know, smoking these things is not technically 'smoking' as they do not contain tobacco and are legal to use indoors. However, as I stated above it is open for individual councils to make their own bylaws (which it has resolved to do in this case) I feel if this was challenged, the Council concerned would have egg on its face..

The only other issue I see is a case for careless driving. It has long been accepted that even the act of selecting a cigerette from the box can cause a loss of concentation. However, if this was their thinking, it certainly does not highlight public safety in the letter...

For your information in 2010 we had a Crown Court appeal over a driver smoking e cigs in a works vehicle the on the grounds that they were exempt from the legislation. The Judge dismissed the appeal and held that the original conviction at Magistrates was correct in law. The fine and costs for the offence were £1100. Hope this helps.
