Hi, can anyone help in regards to a hackney carriage driver having 12 points on his driving licence ( all points gained within the last in 18 months). When he was given his last points he was also banned for driving for 6 months which meant he has to had his licence in. He thinks that after his ban he can carry on being a hackney driver as in his words "there are several hundred Hackneys with 12 and over points according to his insurance company." Can anyone tell me if they know off any licensing Authority that let drivers work with 12 or more points. I thought this would go against the grain of Fit and Proper. |

I thought this would go against the grain of Fit and Proper. our lot granted a license to a guy with 18 points - then suspended a driver for two weeks who had a clean license previously, but was caught speeding and got 3 points. |

The council should have an enforcement policy which will, or should, list how long someone must wait before they can reapply etc. If the mush has just carried on then it will depend when he re-licenses. If his ban was in place when he re-licensed then they shouldn't have issued a new license, unless the mush committed fraud and lied on his application. The chap isn't 'fit and proper', he has been banned and the council should insist he waits 1-2 years before he can reapply. If that isn't the case then send an email to the local press, anon if need be. |

He'll have to go in front of the Council Committee to apply for his badge, if they don't think he's fit and proper then he's had it I'm afraid. |

One of my drivers has hit 12 points 3 times although not in the last few years we persuaded the magistrates tom let him keep his license twice and then it was just a case of persuading the licensing committee that it was a little carelessness on his behalf and with a few letters from customers praising the very helpful and popular driver he was allowed to carry on cabbing |

Thank you all for the comments. He has been up in front of a panel before and was given a warning. I just wondered if there was a national policy or for each council to decide the fate of their licensed drivers. |

Hopefully any new act will bring some sort of one rule fits all situation. |
