| Post subject: | Licence fee increase no consultation |
I found out from one of the cab owners that our council Scottish borders have increased our operator fees by £9.00 without any correspondence or consultation I have checked there website and it say from 1/4 /13 fees will increase from £182 to £191 This owner took out a 3 year licence last year agreeing to pay £182 a year in 3 instalments. He went to pay his second instalment and was asked for an extra £9.00 making it £191, The council cannot increase fees mid term if the contract has already been agreed can they?? I have just sent an email complaint so will have to see what they say, failing that it will be the ombudsman |

I don't no Scottish law. But in England all councils have to consult Under wednesbury principles? |

Even then I doubt that they will look at your complaint on the grounds that they do not have the resourses to examine every complaint. |

A licensing authority shall charge such fees in respect of taxi and private hire car licences and applications for such licences as may be resolved by them from time to time and shall seek to ensure that the total amount of such fees is sufficient to meet the expenses incurred by them in carrying out their functions under sections 10 to 23 (other than section 19) of this Act in relation to such licences. It appears no advertising is needed. However the fees must be 'fair and reasonable'. I would ask for the accounts/balance sheet under a FoI request for the last three years. |

I am more concerned that they have increased by £18 his licence after him taking out a 3 year one the year before, I took out a new one back in Feb when I changed my car so my next 2 payments should be £182 not £191 |

You have a three year vehicle license, but the vehicle is checked yearly and the fees can be paid yearly. If that's the case then that's a yearly license, isn't it? |
