The following paragraph is taken from our new licensing conditions. "No Disclosure and Barring Service report from any other Authority will be accepted. This Council is a registered DBS body and has a robust system for checking applicants and their documentation and only checks made by this council will be accepted." I was under the impression that you only required one DBS disclosure and provided that you had registered for the update service it was acceptable by all. Our Council are saying that they will not accept a disclosure from any other authority. Can they do this? If not can someone point me in the direction of the information that says that they can't? |

Everyone starts with a paper application for the DBS, and clearly that will be with your council. Once the initial application is received back then you can register on line for future DBS requests from whoever and from wherever. That's the reason why this process was changed. I would ask your council if they wont accept legally approved downloads, and why. |

Pillocks Theres ONE original genuine DBS report and its sent to the APPLICANT (i.e. the driver) unlike the old CRB check, its then up to the applicant (say me) to send it to each body requiring to see it The original DBS request forms have to come from an authorised body but they dont see the report unless the applicant sends it to them AFTER that - and if i pay - any body or authority i give permission to may access UPDATES online but NOT the original DBS report Quote: How to get a DBS check
The employer gets an application form from DBS or an umbrella body (a registered body that gives access to DBS checks). The employer gives the applicant (job candidate) the form to fill in and return to them along with documents proving their identity. The employer sends the completed application form to DBS or their umbrella body. DBS sends a certificate to the applicant. The employer will have to ask the applicant to see the certificate. |

He just needs to authorise them to access his DBS account. Then they can check what they need. If the council won't allow that then you complain to your mate the Ombudsman again, or the head of licensing you had a ruck with last year before he finally came around to the correct and legal way of dealing with matters. |

In the 9 page document that I sent to the council regarding the new policy, one of the questions that I raised was that a DBS check from any authority should suffice if the update service was subscribed to. This was not answered by the council. |

Once the check is completed, DBS will send a certificate listing the results to the applicant. The employer will have to ask the applicant to see the certificate. Security features Certificates have security features to prove they’re genuine, including: a ‘crown seal’ watermark repeated down the right side, visible both on the surface and when held up to the light a background design featuring the word ‘Disclosure’, which appears in a wave-like pattern across both sides of a certificate; the pattern’s colour alternates between blue and green on the reverse ink and paper that change colour when wet The security features for a CRB certificate issued before 1 December 2012 are the same as for the DBS certificate. Reusing a DBS check A DBS certificate only contains information from a DBS check on a certain date and for a particular purpose. Employers can accept a previously issued certificate but must: check the applicant’s identity matches the details on the certificate check the certificate is of the right level and type for the role applied for carry out a free-of-charge status check to see if new information has come to light since the certificate’s issue; the applicant must have already joined the DBS update service |

its very simple an employer/council/LA hand the applicant a DBS form that goes back to them with fee they send it off the DBS send the APPLICANT the DBS certificate (NOT THE EMPLOYER/LA) the applicant then shows it to any possible employer who wants one the applicant pays £19 a year and the access online (showing alterations only) is available for anyone the applicant grants it to its obviously hard for some to understand and galling for officials at the council not to be in the loop... |

I have sent the following email to the entire committee and the reserve Councillors as well. Dear Councillor, My name is Peter Faulkner and I am the acting Chair of the Melton Mowbray Taxi Drivers Association. The association represents the views of 43 Hackney drivers within the Borough. The reason for writing to you direct ahead of tonight's REEA committee meeting is to forward to you the full document produced by the association in response to the draft policy consultation because we feel that some very important issues have been ignored or side stepped by the Licensing department in submitting their recommendations due to be adopted at tonight's meeting. The main points are. 1, Age limits. Best practice guidelines state that arbitrary age limits should not be set, the condition of the vehicle should be the main factor. 2, Drivers badges. Best practice guidelines state that a 3 year badge should be issued and not a 1 year badge. 3, Drivers medicals. Why are Hackney and Private hire drivers subjected to medicals every 3 years when bus and lorry drivers are checked every 5 years. 4, DBS checks. A DBS check from any authorized body along with the annual updates should be accepted by the Council now. 5, Penalty Points System. The system as published is basically a shambles with many of the "offenses" being covered by the police, others make no sense and there is no legal requirement for other information to be kept. In summary, the association would ask the committee to reject the policy in it's current form and ask the Licensing team to look again at the policy, perhaps with more input from the trade. There is no "authorised body" DBS check, authorised bodies give applicants the forms and accept them back but (from what I can tell) the check comes back as generic, thats to say my council may give me the forms and send them off for me once completed but I get the check back and theres no mention of my LA on the check, its just "the DBS check" or will they just get confused? the old CRB checks were "per body", my wifes got three here issued almost the last time, LCC accepted Staffs CRB check for an escorts badge.... we have 5 year medicals..... |

The DBS form has the name of the authorized body on it. I have just done some for escorts through LCC. |
