A couple of weeks ago the LA + the police decided to set up a speed trap on one of our flyovers (perhaps flyover being the operative word). The area is a non neighborhood neck of the woods but 30 mph is imposed. In many cases including yours truly it is a 40/45 mph area to safely drive @ say 2.00 a.m when not much traffic is around! However a few as you would expect drivers got caught exceeding the limit and got done by the police for fixed penalty fines + points etc (not a problem as such). It appears that on top of that, the LA also want to impose more punishment onto the drivers, that have already been punished! My thoughts are this; 1. what rights do they have to do this? 2. Do they deal with other council employees who have been caught i.e on official council business Or driving council paid for vehicles in the same way, and are they applying so called discipline fairly across the board? My reasoning being is that they could be seen to be discriminating against the drivers if it is one way only........advice please. |

LA's need reined back into their proper place, they should be the servants of the rate payers instead of trying to act like our masters, they go unchecked and run roughshod over all of us, they should not be allowed to impose secondary punishment to that already meted out by the courts. The trouble is that they are never challenged, they have money (our money) to hire the best legal advisors and they know full well that we can't afford such luxuries. Their leaders are arrogant, the elected councillors just in it for whatever they can get...you and your family and your livelyhood don't matter a stuff to them, and until we get a more electorate sympathetic government to run the country and to who'll put the LA genie back in it's bottle things will not get any better. My only hope is the likes of UKIP breaking up the current three party system and hastening in a new breed of caring politician that puts the voter at the very heart of their idealism. And Pigs might fly...........

As someone who drives professionally, you shouldn't be breaking the speed limit at any time. No doubt the council rules give them the right to take action against ph and taxi drivers who have been convicted of motoring offences, a bit like the Traffic commissioner can take action against the vocational licences of bus and lorry drivers, in effect a second conviction for the same offence. And no, they probably don't take the same sort of action against their own employees as they are not seen to be putting the lives of paying passengers at risk. Maybe someone should take it to the ECHR. Anyone rich enough? |

They have the rights to do anything, if a court views those actions 'fair and reasonable'. It's not uncommon for a council to consider any conviction, be it traffic or otherwise. I think the public would expect that. The same would apply to a licensee selling booze to under age kids. A court could act, and a council could take further license enforcement. If the council write to you, or ask for a meeting, saying you have been a naughty boy, then go along with it. If they wish to take action in respect of suspensions or revocation then clearly that's when you have a ruck. |

If you Drive in public transport obviously all convictions MUST considered by the LA....................and if you have dangerous driving habits...................speeding you should be removed from the industry........................or gormo do you think dangerous drivers should be let loose in Public transport .And yes council employees can and are disciplined for Driving offences obtained during working hours in council vehicles..................this includes dismissal. do you know fekk all Bloodknock

I do not condone speeding in neighbourhoods, but I do use my discretion when the powers that be, put speed limits where and when they are not needed. If you do not like that - then tough, I just do not swallow BS in any form. As an additive, any speed over the limit is in an empty cab, so no one in the cab is ever at risk. When I talk about speeding I am talking about "A" roads in Newport with the same layout, are 40 mph - in Cardiff the land of effing traffic lights the same layout is 30 mph - no difference in terms of safety......just BS to grab money off of the motorist. When I talk about speeding I am talking about 10% +2 mph on top that a police office had the discretion to use - but a cam does not. Out of the drivers caught, only one was speeding with passengers in and that was in a non resi area. |
