Last night one of our drivers was sent on a job to pick a regular customer up, when he picked her up he went a different way to what she unusually goes, he went through an industrial estate only to find out the gate at the other end was locked, he then came back on himself and went a totally different route making the fare more expensive, she knows the price because she has the job regular.

When they got to the other end the fare was £2.50 more than what she usually pays, the driver locked the door and wouldn't let her out, she had her young daughter with her who started crying as she was getting scared. The passenger had to phone her husband to come out and give the driver the extra money so he would let his wife and daughter out of the Taxi.

Has holding someone against their will got legs on this?

I don't suppose that they got a receipt for the fare? Receipts make good evidence.

I am not suggesting that they are. But I bet the first think anyone investigating a complaint will say is "did you get a receipt?"

the money is only a side issue, the driver cant deny his actions, thats what constitutes pi55 poor actions verging on the illegal

the job might have been logged on a despatch system, she was a regular traveller the firm wont see again too

the press might like the story

If the passenger chooses the route than the driver in my opinion should be paid any extra incurred.

If the driver has tried a shorter legal route (as we are all required to do) and an obstruction occurs, then he has done his job - so why should he take a loss? - If they kick up stink the other end, then personally I would attempt to split the difference claiming that neither are at fault and go for a 50/50 split on the extra.

If she pointed out at the time that she was not happy with the route taken - then the driver must take the hit.

She was telling him all the time that he was going the wrong way.

Even the police may be charged with false imprisonment if they exceed their authority (such as detaining someone without justification). In fact, any person who intentionally restricts another's freedom of movement without their consent (and without legal justification) may be liable for false imprisonment, which is both a crime and a civil wrong. It can occur in a room, on the streets, or even in a moving vehicle—just as long as the subject is unable to move freely, against his or her will.
Similarly, "false arrest" is when someone arrests another individual without the legal authority to do so, which becomes false imprisonment the moment he or she is taken into custody.

Wrong in this case, if he felt she was refusing to pay the police should have been called


Your argument is flawed, the passenger had a contract (verbal) to be conveyed along the regular route (as normal) not through some (illegal?) yard with gates at the whim of the driver, doubtless he would have wanted the regular fare for the shorter route, seems he got it wrong and might yet feel the full force of the law and public opinion and his base could kick him off...


If you took a passenger down a toll road on YOUR whim/decision would you add the toll fees to the fare?

The driver was lucky, the husband could have been the type to arrange meals through a straw for the him
