Oh, what a mess!

Local Assoc decides against tariff increase but wants a statement 'A surcharge may be added to card transactions in accordance with.....Regulations....etc.' in order that drivers are not out of pocket on card payments.

Local company asks for tariff increase independently of assoc.

Licensing committee are discussing the possibility of a tariff increase but denying recovery of card costs.

Licensing officer has been sent away to investigate the legalities of the card payments.

My question: A £20 fare input by the driver, automatically becomes £21 when processed by the card company. If the tariff card is silent, who is making the charge, the driver or the card company?

I'd say the £1 fee is as a result of hiring the taxi - therefore the driver is charging it - and lawfully the farecard should be accurate - in total fairness, I gave up with Fareham many moons ago

I don't agree with that, the fare is what is on the tariff card and the customer has the option to pay cash, if the customer doesn't then the card company takes it's charge and providing it's charge is the amount to process the payment and no more and all of the money for the process goes to the card company then it's they that are making the charge.

(ii) 2Where a hackney carriage furnished with a taximeter is hired by distance and time the proprietor or driver thereof shall not be entitled to demand and take a fare greater than that recorded on the taximeter, save for any extra charges authorised by the Council which it may not be possible to record on the face of the taximeter.

You show the "Model Byelaws", not actual Byelaws. They match exactly the "Model" from the DfT in 2005 if I am not mistaken.

I submit to my esteemed colleagues, that if the driver receives no more than the metered fare, charges made by the Bank for processing the transaction are a matter between the Bank and the purchaser of the service and as such are a separate transaction.

I therefore find it perfectly acceptable.

I also therefore accept Credit/Debit Cards and see nothing myself of the Bank charge levied as a result.

My view is the actual price the customer pays in total is the fare.

That includes any booking or admin fees, and for that matter also VAT.
