Taxi Driver Online

In Fareham, we do not have Traffic Wardens. We have Civil Enforcement Officers who patrol both Car Parks and On Street parking. Fareham Borough Council keep the fines they take. One of our taxis is being fined for loading his taxi with goods in a Loading Bay. Some taxi's do have Insurance Cover for carrying goods as well as carrying people before you jump on me. My question is what appeals procedure should there be? Should Fareham Borough Council be allowed to be the final appeal?

Loading a punter or goods in a loading bay is the f***ing reason it's called a loading bay.

Depends on the Goods being loaded, had it been a large item not easily carried by hand then yes appeal, but if it were 3 packs of Lidl Mince pies and a Pair of cheap Lidl Slippers for grannies Xmas then no...That's not really goods that require the use of a Loading bay.

No, the Parking Adjudicator, you may possibly find the Makda Case of use, but this concerned passengers not goods. I think it is in the TDA Court Database.

Agree with cabbyman, take this to Pepipoo. so far I've had 7 parking fines in Shepway, appealed them all, and WON.

Goods loading is loading of goods, nothing in law about the size of the goods. Appeal to Fareham, then the adjuducator. Pepipoo will ask you to post the details of the PCN blanking out the car details. Lots of good free advice on there. You'll find me under the same name on there.

Take a picture of the notice at the loading bay as evidence, unless it excludes taxi's then the driver is clear


i wouldnt even worry about GIT insurance and all taxi's are "private carriers" as opposed to "common carriers"

MCF, your link is a chap called Michael Green. He is a law student who is trying to fund a judicial review to stop DVLA releasing drivers' details to PPCs and also change the law to stop PPCs operating. An admirable cause but it won't help in this particular instance.
