| Post subject: | Event taxi base?... |
On a major music festival, with plenty of taxi work for 4 days, but based out of our LA (by a couple of mile), in a rural setting, how can it be milked? our cars cant "rank" there can they, even hacks would have to be pre-booked? its on private land, can the organisers promote our firm and do a deal to site a 1 man shed/office on site? a temporary freephone?.... |

If the general public have free and open access to where the non local cabs are waiting then it could be viewed as touting. However if only the people at the event can access the 'rank' and those cars have a booking, then I'm not sure what laws are broken. |

If, as stated, the event is on private land then there is nothing to prevent licensed hackney carriages from any authority standing for hire on that land providing two conditions are met: 1 - permission of the land owner (via the event organiser in this case) 2 - that the "rank" is not within view of a public road and positioned to attract business from people using a public road. See Young and Another v Scampion 1988 - http://taxi-driver.co.uk/phpBB2/viewtopic.php?t=4662 In respect of a private hire operator having a booking office on-site the operator, the vehicles and drivers would need to be licensed by the district within whose area the event is taking place. Having a temporary Freephone on-site would amount to operating from the site; as was the case with Bromsgrove v Murtagh 1999 - viewtopic.php?t=3808 |
