Post subject:  LICENCE SUSPENDED

My licence was suspended with immediate effect by hand delivered letter this Monday afternoon on the 16/11/15 citing section 61(1) and the Councils consideration that I am not fit and proper and a potential risk to the public !!!!! On 17/11/15 I went to the Licensing office and handed over my badge and was told I would be called in for a formal hearing.

Last week on Thursday I had been called by a Licensing Officer that a fellow driver had complained to Licensing that I had been "talking about him to school escorts and children that we carry, in a manner that could be seen as inappropriate" ! I told the Officer that the gentleman was a pratt and that I had not talked to him for over a year, and that following an argument he had had with another one of our drivers on the day before - he was some how involving me now. Also I said, if the Officer had any complaint from a child or an Escort, I would happily come in to see him. The Officer took this as being "obstructive and uncooperative" and said he would call me in formally and [b][b][i]if I didn't attend my licence would be suspended/revoked[/b][/i][/b]. The other driver and I were both at the same school (pupil referral unit) and I was already parked in the school car park. When the other driver drove in I looked at him and he began to smile/smirk !!!! My child came and I set off. On the way home we were in a long line of traffic, the other driver behind me although I got out of the car to go into my boot, my eyes caught him laughing again. I went to his window, he put his window down a couple of centimetres and I said "what you playing at" ? He stuck two fingers at me and said "fukk Off". As I moved back I bumped into his wing mirror and impulsively lashed out, thus knocking the mirror backwards. The driver got out, pushed his mirror back into its original position (no damage) !!! Then rather than confront me he ran to the other side of the road asking a stopped driver "did you see that and can he have his number " ? By this time I had driven off and the traffic in front had not even moved thus indicating how little time I had been out of the car. That driver rung the Police, Licensing and our own Taxi company I later found out.
The issue now is that :-
- I behaved in an aggressive manner in full public view.

- Caused great concern to the child in the other vehicle.
- Left a vulnerable 8 year old in a line of traffic on his own in my vehicle.
I know I did wrong !!!! So please don't comment on that. I have had issues with this driver since last December and have evidence of his provocation towards me (which I don't want to discuss here). There are mitigating circumstances, and lots of self incriminating texts he has sent me over the last year including one in which he apologises for heading head on for me on a narrow road !!!!! Bearing in mind, all these factors which I will explain in detail at the hearing to establish mitigating instances that made me react in such a manner.
Your advice as to what could happen ? What steps I should take ? would be greatly appreciated. It is nearing Christmas, and I have not worked since Monday ! I don't even know when this hearing will take place !

Deny everything ask for proof and an independent witness statement and get one on your side (kids in either car dont count)

Advice stop pleading guilty on a public forum for a start then consult your Union!

all complaints against you must be in writing demand a copy of the complaint, then take advice! in private not on here !!

Being off the road is unfortunately a likely event if you deny yourself representation, never represent yourself i wouldnt nor would any experienced Union official.

Stop rising to him 'baiting' you. When he smiles at you smile back ! I have had a 'running battle ' with another driver now for over 3 yrs, ever since he took me to court and it cost him £7200 in my barristers fees. I always smile at him when he glares at me. I have even had a telephone call from one of our LO's asking me not to smile in his direction as it is offending him ! I asked the LO to put it in writing, needless to say, I'm still waiting.

The council have to send a section 300 notice telling you that you have 21 days to appeal or your appeal will be “out of time” and the courts will refuse to hear.

Make a complaint about him....using your texts as evidenve.....putting your passengers at risk....
