lads had a NIP, 72 in a 60, thing is he was being swapped from 1 car to another every shift and looking at the date/time/location hes sure was not there.... hes gone off to get a printout of his jobs that night thing is he has only just got the NIP - posted yesterday - but the offence was march 5th, i feel he has been selected as a fall guy to take the blame the despatch system asks for driver and company id to login but not car reg, unlike Mercury |

They then have, I think, 4 weeeks to respond with the drivers details. The police then send out a new NIP to the nominated person. He will have the same period to respond stating if he was the driver or not. |

wannabeeahack wrote: the despatch system asks for driver and company id to login but not car reg Someone must think he was driving that particular car at that time and location in order for him to be passed the NIP, presumably the vehicle owner.However if the driver was logged into the system it should show which job (if any) he had and where he might have been at the time of the offence, or whether he could have got from his last known location to the site of the offence within a certain time period. |

I am sure I read on pepipoo, that he must receive the NIP within 14 days of the offence, or it can be thrown out. |

If they are not the driver as well then they send it back within 28 days and the nominated driver is then sent a new NIP. |

The courts take a dim view on operators of vehicles who fail to keep proper records of who was driving and when; that also applies to small operators who use vehicles in connection with their trade or business. the "can't remember who was driving" won't wash any more unless there was a Very good Reason for not knowing. Penalty up to £1000 plus costs for not knowing and up to 6 points. Maybe the driver should change his name by deed poll to Don B. Yakhunt. |

i reported a driver seen overtaking on double white lines, handed over video and stills and made a statement cops came back... company car any driver insurance no id of driver no case |
