Hi all,

Was just looking for advice regarding in-car CCTV in my taxi. There's been a bit of a drive in our area and a lot of drivers installing various systems in their vehicles (some driven by a 'pilot' scheme by the Council).

Myself and a few other drivers have one from Crash Catcher that is dual camera. Both cameras can be pointed inward or outward, or most commonly one inwards and one facing the directions of travel. We all have different but clear stickers that CCTV is operating within the vehicle. Other drivers have similar systems to record inside the car. I couldn't tell you if they are recording sound or not.

I've just read on a Facebook page that this is illegal and subject to the Data Protection Act etc to record inside the vehicle/taxi.

Can someone clarify the rules for me as to what is or isn't allowed please?

It is not illegal to record images of the interior of your vehicle. There are, however, rules that you must comply with.

You must display notices informing passengers, in the vehicle, that CCTV recording is taking place.
You must not, routinely, record audio in the vehicle. Audio recording should only be activated in emergency situations.
You must be registered with the Information Commissioners Office as a Data manager.

You will find all the information you need here :-

Thanks for the reply. Is there a cost associated with registering as a Data Manager? Also, is it the same law for Scotland as I know there are differences in other legal issues began England and Scotland?

The above is absolute bollocks.

As long as you have stickers saying that you have CCTV, and that the person who controls the data has the correct license to do so, then you are ok.

There is tonnes of info on the net, and a lot of that is good info.

But make sure the camera is pointing at folks heads, not their bottom halves.

It's a £70 one off payment and that's it.

so, before the council insist we have encrypted £750 systems, we must register to use our own systems for our own security besides paying for CSE courses, badges, and fck knows what else?

The data controller needs to do the registering, if the driver has no access to the data, i.e. it's encrypted, then only the down-loader of the data need a license.

The council could be the data controller, but usually it's the installer that is the data controller.

There is a good argument to be made that the driver should data control his own data.
