Post subject:  cant be true, just cant be surely??

my mate had just had his application for a badge refused( so far) due to some dodgy dealings in the past, so is awaiting a final decision ( tomorrow) it is one of 3 scenarios
1) - point blank refusal
2)- gets badge with warning that it will be revoked immediately if there is a complaint
3)- gets told to re apply in 6/12 months or whatever

anyway that's all fine, but he works a control desk jockey and has for about 3 years, he is now taking the discrimination route , as he rents cars out ( perk of being in a chit office & is allowed to have 2 or 3, cant remember , cars on rent free as hes on a chit wage), now one of the lads he rents a car to is asian said he never had a police check as they couldn't check his status from Pakistan, so never had one, surely this cant be true ????

Presumption of Innocence until proven guilty is a pillar of our justice system so if no data is available it's quite right that licences are issued.

If they cannot produce the same information as that required of a British driver then they should not be granted a licence....after all it is supposed to show that the driver is safe.....there is no point in having one at all otherwise..

that's what i thought tbh , that bloke could be a rapist or anything & they cant check ?? , if that's true there is something seriously flawed in the system :shock: , i was talking to my mate again today & he claims is true( why would i bother fighting it if it wasn't ) he also claimed that a few years ago the asians had 6 months grace for the knowledge test to learn the area, yet we had one to get our badge? no idea if this is true either though, i don't really get involved, i would have been non the wiser if he hadn't phoned up full of hell :lol: :lol:

Doing this would surely bring them into conflict with there duty of care to the general public.

Any one of us, could potentially have a conviction from Pakistan UK citizen or not The duty of care is to check for convictions via a UK CRB. If none can be found it must be assumed that there are none

Maybe the solution is to have 3/4/5/10 years free of convictions in this country, and if you can't show that then you wait till you can.

So anyone that has been abroad in the last 3 years can't get a badge in case they committed a crime on their holidays?

I don't see what's so hard to understand about it being wrong to deny someone the opportunity to earn a living because they can't prove that they haven't committed a crime.

It would go against everything British justice stands for

Do you not know why the CRB was brought in? Do you not remember the two little girls who were killed by the school caretaker who had serious doubts logged about him in different departments, which a police check didn't uncover? The CRB check now certainly would. The CRB check was brought in to protect the young and vulnerable, to which I would think the vast majority of the public would agree with, excepting you of course. Its biggest fault is that although it applies to the British public in full, it can be side-stepped by the EU due to its law regarding freedom of work, which this country should be able to control, especially regarding the young and vulnerable. Laws often clash but you have to evaluate which law is for the greater benefit. It's just another reason to get out of the EU and get our autonomy back.
