I drove from East Yorkshire to Salford to collect from the Uni and I'm pictured in a bus lane. On my return I get a notice of intended prosecution for £30. I send copies of my private hire license. They say it's Hackneys only so I appealed via the appeals tribunal on the basis that 2 pictures on the charge sheet do not show my car in a bus lane (one picture showed my car as a dot in the distance the other showed a number plate with everything else blacked out)
Also, Salford council said video evidence was available at a web address, when I looked it was just the two pictures. After I appealed they changed the pictures to a video, is this legal?
Anyhow the appeal tribunal rejected all my points but upheld my appeal because the camera operator had retired. It all felt as bent as a two bob watch.
Should private hire vehicles be allowed in bus lanes and should local authorities be forced to provide proper photographic evidence if they want their 30 quid?

The folks on www.pepipoo.com will tell you if there is any way of avoiding the charge.

However, the bus lanes usually say 'taxis.' In law, a PHV is not a taxi.

And in some areas it states WAV's only or local taxis only so even out of town hacks can't in many places

It all depends on the traffic order that put in place the bus lanes.

Some councils allow taxis and ph from all areas free access to their bus lanes, some just allow taxis, and some allow neither.

My view is I never drive in bus lanes outside of my area unless in have read the traffic order.
