Post subject:  Bike link (licensed/unlicensed) NSH transport.

Has anyone come across this outfit before? http://bike-link.co.uk/ They seem to be doing patient transport work here in the Barrow area and elsewhere, but I have not seen any plates on the vehicles. Are they exempt in some way?

Are private courier companies allowed to use blue lights then ? I always thought it was only the emergency services

I thought that about the blue lights as well,but they do seem to be using ex-paramedic cars for blood runs etc, Complete with blue lights, seems to be a good excuse for speeding to me.

Got a similar lot down here.

As you can guess I've been over the legislation/best practise guidance with our LO, and my view is that these kind of outfits are working as PH without a license, but it's a very close thing.

The reason it is close is because the DfT gave guidance on this issue a little while back and appear to say it's legal. My view is statute law says its illegal.

But it's going to take 100s of 1000s to prove either way. :sad:

here NSL care services (aka ambulance service) use taxis and PH and also non-plated cars, they have to be vetted/inducted, but 1 base owner who hasnt got a plate/badge nicks the better jobs (£15 a time) for pocket money

This sort of thing may be compared with the Glockner Ambulanz case in Germany a few years back. That case was eventually heard by the EJC and love it or hate it, (results awaited tomorrow 8) ) that judgement will have a lot bearing here.

Glockner was a private company providing PTS in a small German state and the state stepped in to undercut them using spare capacity on emergency ambulances. From memory, they also investigated the hire and reward aspect of the problem.
Edited to add this case defined hire and reward as being "for any financial activity regardless of the status of the operator" and this is one of the key cases Martin Allen has relied on in his battle against the s19 minibuses.
