Subject: Criminal Law


Abstract: D, a taxi driver, having discharged a passenger, drove to a rank where he plied for hire. A constable found his meter still ticking. He was convicted of (a) failing to stop the mechanism of the meter as soon as the hiring was terminated and (b) sooner than when the cab was hired, setting the mechanism of the meter in motion, in each case contrary to the London Cab Order 1934 para. 39.

Summary: Held, that D was guilty of (a) but (b) was intended to be an alternative and the conviction for (b) would be quashed.
