In a hack fitted with a meter when is it to be used when carrying fare paying passengers? journeys wholly within the LA? Journeys only partly within the LA? Journeys at no time within the LA? |

Easy. 1 Journeys wholly within the LA? The meter must be used. 2 Journeys only partly within the LA? The meter may be used or a fare may negotiated which negates the need for the meter to be used. No negotiation means meter is used. 3 Journeys at no time within the LA? This by definition must be a Private Hiring so if the person (often a PH Operator) has agreed a fare with the passenger, that is what it is. If the agreement is "Using the meter in the Hackney Carriage set to the Tariff for Lichfield (for example)" then that requires the meter to be used even if the whole journey is in Cornwall. NB. Simple. The City Council in Lichfield have produced a Bye Law (Tariff is part of the Bye Laws) which is unenforceable as it flies in the face of National Legislation. Wannabe, tell them to sort it out.

Section 68 TPCA 1847 (make Bye Laws) If they fix rates or fares under Section 68 how is it unenforceable? That rate or fare that has been fixed then becomes part of the Bye Laws until it is changed. |

The last bit is also correct but again it only holds water WITHIN THE LA AREA "That rate or fare that has been fixed then becomes part of the Bye Laws until it is changed." |

Now if your a hack and you receive a phone call from inside your district, you could then be classed as a PH, In Scotland because many hacks are operators, in their own right,, rank work within district meter on, phone calls direct to the driver PH, drivers discretion |
