| Post subject: | Was I in the wrong? |
Went to a 2 car job...picked up....put the meter on, meter fare was £7.50 passenger had prepaid the base by card I asked base after dropping off and was told it was £10 per car so id put the meter and hadnt requested more than the fare myself... |

Assuming it was in your licensing area, and your a HC,then your not allowed to charge more than the meter. |

Town and Police Clauses Act,Section 55 makes you the driver totally responsible in this case of overcharging,if the passenger who pre-paid made a complaint you most probably would be prosecuted and be convicted as there is no cause for defence in this kind of situation. This is why there is a difference in the rules and private hire operators should only be using private hire vehicles. |

I made no comment, didnt request ANY monies, gave no receipt and as our regs state a driver nor operator may DEMAND a fare higher than the meter im safe......lol..... |

Section 55 does not contain the word demand,read it and you will find it is about an agreement of paying more than the fare allowed. |
