Post subject:  Was I in the wrong?

Went to a 2 car job...picked up....put the meter on, meter fare was £7.50

passenger had prepaid the base by card

I asked base after dropping off and was told it was £10 per car

so id put the meter and hadnt requested more than the fare myself...

Assuming it was in your licensing area, and your a HC,then your not allowed to charge more than the meter.

must be the base in trouble then as i never got chance to ask for any monies

£2.50 tip...lol

Town and Police Clauses Act,Section 55 makes you the driver totally responsible in this case of overcharging,if the passenger who pre-paid made a complaint you most probably would be prosecuted and be convicted as there is no cause for defence in this kind of situation.

This is why there is a difference in the rules and private hire operators should only be using private hire vehicles.

I made no comment, didnt request ANY monies, gave no receipt and as our regs state a driver nor operator may DEMAND a fare higher than the meter im safe......lol.....

Section 55 does not contain the word demand,read it and you will find it is about an agreement of paying more than the fare allowed.
