 Post subject: loading and unloading?

Can a hackney carriage drop off or pick up passengers in an area that does not allow loading and unloading?
Basically one of our drivers has just dropped off an 11 year old girl at our local cinema. He stopped the engine and escorted the child accross the road. A civil enforcement officer told him that he could not stop and unload his passenger because loading and unloading is not opermitted on that road. He pointed out that he wasn't unloading but dropping off a passenger. The enforcement officer said that they didn't think that the passenger would mind walking from the car park round the corner. The driver pointed out that the passenger was an 11 year old girl at which point the enforcement officer said "you either move the car now or I give you a ticket."
Was the driver in the wrong?

Just ead the highway code on road markings and it states that anyone can stop whilst passengers board or alight where there are no loading or unloading markings.

I think the London Red Route case also confirms that.

If a judge says a licensed vehicle can drop off and pick up in a Red Route, then I'm quite sure that would apply to a non loading area.

You also have the benefit of licensing conditions that state (something like) you must offer all reasonable assistance etc.

It could be therefore said that if your driver didn't do what he did he could get prosecuted, or have his licensed reviewed.

May I refer the Rt.Hon. Genteleman to my case Gould-v-ShepwayDC listed in the court cases section here. The answer is yes you can stop to pick up and set down passengers as well as escorting them to and from premises.

If the CEO gives your driver a ticket, appeal it is the simple answer.

I did suggest that it would have been a good idea to get the ticket because I was sure it was ok. Oh and Rt Hon is for members of the Privy Council, I am still waiting for my invite. :wink:

What if the sign reads "no stopping at any time" is that open to interpretation as well?

Ah, but they don't in the situation our driver was in. Rules are different on red routes and of course everything is open to interpretation. If you break down in are area that states no stopping, what can you do? If the volume of traffic is such that it is not moving, what can you do? if there is an accident closing the road, what can you do?

That's sort of what Red Routes in London are, but licensed vehicles are allowed to pick up and drop off in them.

ONLY IF THEY HAVE THE APPROPRIATE BADGING ON THE VEHICLE ....many Chauffeur Company's DO NOT BADGE THEIR VEHICLES APPROPRIATELY AND GET NICKED :badgrin:
