 Post subject: Operator Responsibility.

Is an operator responsible for private hire drivers actions whilst working on their operators licence, and is there any punishment for the operator if their drivers are doing things that they shouldn't be as a PHV driver?

Depends what laws he has broken or is it a complaint?

the operator holds his licence so if he ***** up kick him off

They are only responsible if they haven't taken all the reasonable steps to ensure the driver is a 'fit and proper' person to have work passed onto him by the firm, and haven't ignored warnings.

Private hire operator uses a private hire vehicle and driver to fulfil a booking.The vehicle is stopped by police or enforcement with passengers on board for some infringement,driver is asked to produce insurance as it shows on the police data base that the vehicle is not insured,on failing to produce a current certificate the passengers are instructed to vacate the vehicle,the driver is told he will be prosecuted for no insurance,the vehicle has to be removed from the highway on a low-loader,the private hire operator will be prosecuted for supplying a vehicle not fit for purpose ie. no insurance.

The question was about the driver, so why on earth are you going on about the vehicle?

I very much doubt the OP needs anyone to tell him that if a vehicle isn't insured the operator is open to enforcement actions, I believe they call that the f***ing obvious. :-s

The driver is probably not guilty as he would assume his employer insured the vehicle. It's been tried and tested many times when driving employer's vehicles.

Gentlemen, may I refer you all to the OP. The question was regarding the driver doing something that they shouldn't be doing. Not the operator failing to insure the vehicle.

As a driver doesnt need an PH OPs licence but a car does, I assume this relates to an owner driver running on a base ops licence.

and yes, the OPs licence holder has certain responsibilities but the LA can come down on the base AND the driver

If i hold an ops licence and a vehicle is operating on that I dont own, Im liable for (say) any complaints or licensing demeanours.

Depending what the licensing misdemeanours are,in all probability YES.

Mind raping children flogging drugs child prostitution you know the normal sidelines for PH drivers and cabbies in Rotherham Rochdale and elsewhere with your knowledge will get you a nice term in the NICK :D :D Unless of course the Coppers are taking backhanders or getting stuck in themselves as in Rochdale and Rotherham you might get away with it for 10 or 20 years you never know :P :P
