I think it's madness and I'm struggling to fathom out how this condition can be net on a large PH fleet. http://www.swansea.gov.uk/media/3958/Pr ... ire_Op.pdf Condition 22. The operator must ensure, at the start of any shift, by examining the vehicle, that the signs and plate are displayed on the vehicle in the correct positions. |

I can only think that the people setting this condition don't have a clue how a sizeable ph fleet works. |

Could delegate that task to the driver who then has to sign a vehicle check book acknowledging that the examination had been carried out and everything was in order. |

I don’t think the wording allows that, although I suspect that might be what happens. The reason I highlight this condition is because that’s what caused Uber to not get licensed in Swansea. Now to me that tells me Uber aren’t as brave and litigious as some may think, as that condition would be an easy win in court IMO. |

I think the condition must allow for delegation otherwise it would mean that the person named on the operators license would have to be available 24 hours a day to carry out this task and that would be unreasonable. |

In the bus industry the operator must ensure that the operator's licence is present and displayed on the vehicle. This is delegated to the driver on his first-use walk-round safety check. He has to either fill in a safety check report which covers any defects AND that the O licence is present. Does the OP's rule state WHO the operator is? If it is a limited company, a limited company is a bit of paper, not an actual person. I would suggest it's not unreasonable to make a driver do a quick inspection of the vehicle before h starts using it. Lights, tyres, body damage, wipers, washers etc. All basic stuff. It might just keep a few more illegal vehicles of the road. |

It's mad, completely mad. What provisions do the council have to make taxi drivers do likewise? I suspect none. If it can be delegated to drivers then why not make it a driver license condition? |
