A driver here yesterday was booked as a 6 passenger vehicle for a multi pick up. There were 3 passengers at the first pick up and the meter was turned on for 6 passengers. when the driver got to the second pick up there were 4 more passengers making 7 altogether. The driver stated that she could not take them all because she was only licensed for 6 so she then continued with the 3 passengers.

The question is was she correct to be on the higher rate because at the start of the journey she was booked as though there would be 6 passengers or has she inadvertently overcharged them?

Yes, the driver was in the right to continue the journey at the higher rate due to the vehicle type being supplied as requested. It met it's obligation according to law of contract.

I’ve had customers complain at multidrops that there are only 2 of them left in the cab so why am I charging the £3 extra. #-o

I suppose it depends if it's a hackney or PH.

Even if it's a PH if the fare chart says 1-4 X price, 5-8 Y price, then you could be viewed as unfair trading.

I suppose it depends if it's a hackney or PH.

Even if it's a PH if the fare chart says 1-4 X price, 5-8 Y price, then you could be viewed as unfair trading.

It was hackney.

the correct rate would be T1 as only 3 passengers carried

unless the journey started outside the boundaries in which case you might be able to argue that the meter rate is not relevant

A previous licensing officer told me a few years ago that if the job is a multi pick up and expected to be for 5-8 passengers then it should be at the rate for 5-8 from the start. Are you saying that it should be at rate 1 until the 5th passenger is picked up and then change the rate to rate 5? Also if it is the reverse and say 8 passengers start the journey with multi drops that as soon as the number of passengers drops to 4 that you then reduce the rate?

To me it's quite simple.

If you are a hackney working within your borough you follow the approved tariff chart.

If you have 1-4 people in your cab you charge them the 1-4 people rate.

If you have 5-8 people in your cab you charge them the 5-8 people rate.

Doing anything else is surely a breach of your bylaws, no matter what the customer booked.

So at what point do you change the rate? Or do we just refuse jobs that have multi pick ups or drop offs?

Surely the bylaws for the Authority make it clear what can be charged and how to apply the charge when a Hackney Carriage is engaged to do a private hiring,or are we discussing the use of a private hire vehicle in which case the operator decides the rate to be charged.

as previously stated, it was a Hackney and there is nothing in the bylaws to cover this scenario.
