We have duel badges here so conditions are placed on all drivers. In those conditions are 2 that say within 12 months of being granted a license the driver has to have completed a course on child sexual exploitation and another on disability awareness. Quite a few drivers for what ever reason have not done this training and are now being given one last chance to do the training organised by another council. Our last CSE course was on July 4th this year. I am told that 2 drivers have already surrendered their badges but around 10 more haven't done the training. Licensing are looking to have their licences revoked.

This is the big downside of the "Dual Badge". If they suspend, revoke or refuse to renew the Dual Badge (because the PH part allows them to) you're snookered.

Another downside is that PH are in effect paying for Ranks, Rank cleaning and other things only Taxi. Hackney drivers are paying for enforcement etc. on PH.

On appeal, could a Driver aggrieved, via a good Brief, call for the PH part to be treated separately to the Hackney part, it would be interesting - the Court could possibly uphold the decision to (revoke) the PH but disallow on the Hackney. This would force the LA to issue a Hackney only Badge.

If I were one of the Drivers and Hackney I would ask for a Hackney only Badge. Hackney Drivers can only be ruled by Bylaw and not Condition.

If the LA want a rule they can enforce, they have to institute new Bylaws, they could (and should if it is safety) include the Courses they want completed by Hackney Drivers.

I think Dual Badges are a bad idea, for Licensee and Licensing Authorities. A potential nightmare for Courts, a gold mine for Lawyers.

Dual badges should not be issued as driver licenses are issued under different sections and different Acts.
We were able to convince our Council to stop issuing dual badges by using the different parts of the Acts regarding fees and the Cummings v Cardiff court case.

Better for the council if they just didn't re-license as and when.

But the thing is.....let's say you were a very naughty boy and were to lose your PH licence for pirating, would you also lose you hackney licence....??

South ribble council have a link to online training, test & certificate on completion. Perhaps you could ask your LA if your drivers can utilise this course to satisfy yourLA's conditions?

When the person holds a dual badge the answer probably is YES,if they are individual licenses NO.
