Can a LA make a regulation about PH but not to a HC?


"All PHV must carry door signs showing the base ID"

Most HC's here are doing "PH work" through a base....

That a hack working via a base (as a PH but in its own LA) be required to have door signs showing the base name

Correct me if I'm wrong, but:

(A) - HC-only circuits are unregulated. So, for example, a criminal could run an HC circuit from London, using HCs licensed in Bristol. So don't see how these HCs could be made to carry the circuit's name or phone number - in licensing terms, the circuit simply doesn't exist.

(B) - PHV circuits require to be licensed because the legislation says that anyone making provision for the invitation and acceptance of bookings for private hire vehicles (not HCs) needs an operator's licence. So not unreasonable for PHVs attached to that circuit to carry details of the operator.

(C) - So a mixed fleet circuit is essentially wearing two hats at the same time: (A), an unregulated HC circuit, and (B), a licensed PH operator.

To that degree I don't see how a council could require HCs to have the circuit's details on the vehicles.
