Plying for hire legally


Touting

can a hack in its own LA be accused of touting? (i.e. sitting parked other than on a rank)

Plying for hire is a passive activity, ie driver just sitting in car.

Touting more pro-active - shouting at people from car, or getting out of car and approaching people (soliciting or importuning).

So an HC sitting on an unofficial rank (say) in the normal manner isn't touting, it's still plying for hire, but plying for hire where it shouldn't be. So a bit like if it was sitting on an official rank out-of-area - it would still be plying for hire, not touting, but plying for hire illegally.

That's how I see it anyway :-s

According to York City Council, a HC can ply for hire anywhere between the hours of 7pm and 7am.

9) The driver of a hackney carriage shall, when plying for hire in any street and not actually hired:-
(a) proceed with reasonable speed to one of the stands appointed by the Council (excepting
between the hours of 7pm and 7am when the driver may ply for hire free from such
requirement)

There are 857 hackneys in Sheffield but,probably only maybe 70 public rank spaces and some of them are only night time ones ,consequently there are many unofficial ranks (outside bars etc).in the old days at the weekend I would come out at 9.30pm and never touch a rank hunting (plying) for work.The council said and says we can park anywhere at night so long as we don't impeade any other road user or cause obstruction .

I think we have two ways of looking at it.

One the legal way, which is waiting only at a designated rank, or the 'turn a blind eye' way which clearly happens in Yorkshire.
