Is any of this NOT something they cant do? Quote: 3.7 This includes a number of key improvements, including:
Proposed introduction of a penalty point scheme designed to improve driver standards Proposed introduction of requirement for drivers to undertake disability awareness training Proposed extension of the upper age limit of vehicles to seven years Proposed introduction of DBS checks being carried out at a minimum of every six months Proposed requirement that all Private Hire Vehicles are required to provide information to passengers including driver photo ID and the vehicle licence number, in advance of a journey Proposed introduction of a condition that drivers cooperate with requests from authorised compliance officers in other areas |

Quote: Proposed introduction of DBS checks being carried out at a minimum of every six months I'm not sure a court would find that reasonable, especially as the DfT Best Practise says every three years. Also the police have a duty to report any issues to the body that requests the DBS check. |

Or maybe as it's section 73 they haven't read that far down the act yet. |

It's titled 'Obstruction of authorised officers', which begs the question, who is an authorised officer, and where does his/her authority to act come from? I don't know the precise answer, but the question begged is presumably why there are cross-border enforcement difficulties and why LAs are having to develop enforcement protocols and that kind of thing to deal with them. And hence the proposal in Wanna's area. (Didn't the Law Commission examine cross-border enforcement or suchlike? A licensing officer who authority has been authorised by councillors. The authorised officer situation is the pain that has stopped 'out of town' cars being properly enforced, as the acts say only an authorised officer can check your vehicle/driver. And very few officers are authorised by more than one council. |
